1. Introduction

Welcome to BrightNowit! These Terms of Service ("Terms") govern your access to and use of the website BrightNowit.top (the "Site") and the creative services, information products, and goods provided by BrightNowit ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

2. Scope of Services

BrightNowit offers the following:

• Creative services for brand visuals, including logo design, brand identity, and marketing graphics.
• Information products such as digital courses, ebooks, and templates.
• Physical goods like branded merchandise.

3. User Responsibilities

You agree to provide accurate information when placing orders, to comply with all applicable laws, and not to misuse our services or content. You are solely responsible for securing rights to any materials you provide for our creative work.

4. Payment and Fees

All fees are due in full before we begin any work or deliver any products. Payment methods accepted will be displayed at checkout. If payment is not received by the due date, we reserve the right to suspend or cancel your order.

5. Refund Policy

We strive to ensure your satisfaction. Refunds and exchanges are governed as follows, depending on the type of offering you purchase.

5.1 Creative Services

If you cancel a scheduled service at least 48 hours before the agreed start date, we will issue a full refund to your original payment method. Cancellations made less than 48 hours before the service date are not eligible for a refund, as time and resources have been allocated to your project. You may request to reschedule your service once, up to 24 hours before the original start date, subject to availability. To cancel or reschedule, please use our contact form.

5.2 Information Products

All digital products are delivered instantly upon purchase and cannot be returned once access has been granted. Due to the immediate delivery and intangible nature of these products, all sales are final and we do not offer refunds. If you experience technical issues accessing your purchase, please contact us within 7 days of purchase via our contact form, and we will assist you or offer credit toward another product of equal or lesser value.

5.3 Physical Goods

If you receive a damaged or defective item, or if you wish to return unused and unopened merchandise, you may do so within 14 days of delivery. To initiate a return, please contact us via our contact form with your order number and details. Returned items must be shipped back at your expense. Once we receive and inspect the merchandise, we will issue a refund to your original payment method within 10 business days.

6. Intellectual Property

All content on the Site and materials delivered as part of our services remain the intellectual property of BrightNowit, unless otherwise agreed in writing. Upon full payment, we grant you a non-exclusive, perpetual license to use the final deliverables for your business purposes.

7. Limitation of Liability

To the fullest extent permitted by law, BrightNowit will not be liable for any indirect, incidental, or consequential losses arising from your use of our services, information products, or goods. Our total liability for any claim related to these Terms will not exceed the amounts paid by you in the 12 months preceding the event giving rise to the claim.

8. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any dispute arising under or in connection with these Terms will be resolved exclusively in the courts located in Ottawa, Ontario.
